Nueva Zelanda: Proyecto de enmienda de la Ley sobre Relaciones Laborales (prohibición de competencia)

  • El 22 de septiembre de 2022, la Parlamentaria de Trabajo Helen White presentó el Proyecto de enmienda de la Ley sobre Relaciones Laborales (prohibición de competencia) en el Parlamento. 
  • Su objetivo es modificar la Ley de Relaciones Laborales del año 2000 para incluir una disposición sobre cláusulas de no competencia que «prohibirá el uso de cláusulas de no competencia en los contratos de trabajo de los empleados de ingresos medios y bajos». 
  • El proyecto de ley también exigirá a los empleadores de empleados con altos ingresos a considerar cuidadosamente si una cláusula de no competencia es adecuada para dichos empleados y, si insisten en incluirla, compensar a los empleados por ello.

First proceedings under USMCA United States-Mexico-Canada Agreement (USMCA)

  • The first two complaints using the RRLM were filed in May of this year. The American Federation of Labour and Congress of Industrial Organizations (AFL-CIO) filed a complaint against Tridonex on 10 May 2021 and the United States Trade Representative filed a complaint against General Motors (GM) on 12 May 2021.
  • On 10 August 2021, the Tridonex case ended with an agreement between the Company and the US Government.
  • On 17 August 2021, workers at General Motors plant, after an initial vote in April marred by spoiled ballots, voted to scrap their collective contract under the supervision of independent observers to guarantee a fair vote.

  • The new trade agreement between Canada, Mexico and the USA could limit Mexican companies to export to the US or Canada because of labour disputes. 
  • The Employer’s federation CCE, provided tools for Mexican business to prevent this from happening.
