Japan: an antitrust case with an impact on algorithms used by the companies

  • The Tokyo District Court rulled that a restaurant review platform's unilateral change to its rankings algorithm violated the Japanese antitrust law that prohibits abuse of "superior bargaining power."
  • The decision shows that, even if Big Tech groups have long argued that their algorithms should be considered trade secrets in all circumstances, courts and regulators across the world have begun to challenge that position.

  • The survey was conducted between 21 February and 13 March 2022 in more than 30 countries worldwide.

Japan: Government is working on a plan to offer employers bigger tax breaks

  • The government proposed a package aims to overcome the economic crisis brought about by the pandemic, including beefing up support for companies actively raising employee wages.
  • It is working on plans to raise the maximum tax deduction rate to 40 per cent for small businesses and 30% for large corporates that increase employee wages.

Indonesia: a new COVID-19 risk assessment service for enterprises

  • On 28 September 2021, a web-based Covid-19 risk assessment service has been launched by Minister of Manpower, Ida Fauziyah, Deputy Chief of Mission of the Embassy of Japan, Masami Tamura, and Michiko Miyamoto, Country Director for International Labour Organisation (ILO) in Indonesia.
  • The project, under the ILO’s Enhancing COVID-19 Prevention at and through Workplaces project funded by the Government of Japan, aims to promote job creation by enhancing enterprises’ safety measures to ensure safe and sustainable workplaces.

Japan, new law to deal with harassment and abuse of power at work

  • The Comprehensive Labor Policy Promotion Act (CLPPA) (No. 24 of 2019 (Reiwa)) aims at eliminating sexual harassment, harassment against women and workplace bullying (known as “power harassment” in Japan)
  • This Act requires companies to put in place a policy to prevent harassment in the workplace, including taking measures to avoid recurrences
  • Failing to comply with this Law entails reputational risks, as companies’ names may be disclosed
