Hong Kong: Labour Advisory Board announced changes in the 418 Rule

  • The Labour Advisory Board (LAB) in Hong Kong has agreed to relax the "418" requirement, using aggregate working hours of four weeks with a 68-hour threshold.

  • On 21 February 2024, Mexico introduced new provisions for the registration and renewal process for individuals and legal entities for specialised services and works. 
  • The latest amendments to Mexico's Federal Labour Law, specifically Article 15, are designed to tighten the oversight of specialised services and works within the country. 
  • These changes, published in the Federation's Official Gazette, aim to ensure that entities providing specialised services are compliant with local regulations and maintain high standards of operation.

New rules from the European Parliament on access to social security for EU workers

  • On 16 December 2021, negotiators from the European Parliament and the Slovenian Presidency of the Council of the EU announced that they had reached a provisional agreement on the revised texts of the European social security coordination regulations.
  • The agreement facilitates labour mobility within the EU and, at the same time, safeguards workers’ social rights in cross-border situations.

A “flexicurity” approach in the platform economy

  • Flexicurity is an integrated strategy for enhancing, at the same time, flexibility and security in the labour market. It attempts to reconcile employers' need for a flexible workforce with workers' need for security.
  • The “Hilfr agreement”, signed by the cleaning platform Hilfr and the United Federation of Danish Workers, is one of the first examples for collective bargaining and of attempt in flexicurity terms in the platform economy.

India: Federation of App-based Transport workers (IFAT) calling for gig economy workers to be covered by social security in the future

  • On 20 September 2021, the Indian Federation of App-based Transport Workers (IFAT) filed a Public Interest Litigation (PIL) before the Indian Supreme Court seeking to classify gig workers as ‘wage workers’ with better social security and employment benefits.
  • The petition demands that gig workers be declared as unorganised workers and be entitled to social security benefits under the Unorganised Workers Act 2008, that provides social security and welfare to unorganized workers with no employment contracts.

Argentina: Benefits for new hirings

  • Decree 493/21, published in the Official Gazette on 6 August 2021, provides for a benefit of reduction of an employer's social security contributions for the case of new hiring of personnel who participate, or have participated, in Educational, Vocational Training or Labour Intermediation Programs of the Ministry of Labour, Employment and Social Security.
  • The decree became effective on 1 September 2021, applying to labour relationships that begin during the following 12 months.
