Australia: Workplace Gender Equality Agency published the first gender pay gap data

  • The Workplace Gender Equality Agency (WGEA) has published the first median gender pay gaps for Australian private sector employers, reflecting the Albanese Government's commitment to remedying inequities in the labour market.
  • It follows the adoption of the Workplace Gender Equality Amendment (Closing the Gender Pay Gap) Bill 2023, which requires the WGEA to publish the gender pay gap of relevant employers. This aim is to promote transparency and address gender pay gaps, as we reported here
  • This reporting requirement also includes information on sexual harassment, harassment on the grounds of sex, or discrimination.

Barilla: New Global Policy on Maternity and Paternity Leave

  • On 10 October 2023, Barilla, Italian excellence in the production of food products, announced the adoption of a new maternity and paternity leave policy, which will be implemented from 1 January 2024 worldwide.
  • The policy will guarantee 12 weeks of fully paid leave for each parent, regardless of gender, marital status, and sexual orientation.

Canada: Pay Transparency Legislation Entered into Force in British Columbia

  • As we reported last May, British Colombia adopted the Pay Transparency Act, which addresses systemic discrimination in the workplace and aims to reduce pay gaps affecting women, people of colour, people with disabilities, and non-binary people.
  • According to the Act, employers can no longer ask job applicants about what they were paid in previous positions. 
  • From 1 November 2023, all employers in British Columbia must include pay ranges in job postings, prepare reports identifying systemic pay discrimination, and disclose pay information to employees and applicants upon request.
  • The Pay Transparency Regulation (BC Reg 225/2023) was released on 23 October 2023 and is now in force. It provides details on the mandatory contents of the remuneration transparency reports.

  • In ruling C-331 of 2023, Colombia's Constitutional Court declared the right to disconnect from work a human right that applies to all employees, regardless of their role and function, including those who perform public functions and those in managerial roles.

Italy: A Decision on indirect gender discrimination in job advertisements

  • On 3 July 2023, the Supreme Court confirmed the principle that the stipulation of equal height for men and women (1.60m) as a requirement for employment constitutes indirect discrimination against women. 
  • The same requirement is neither objectively justified nor relevant and proportional to the duties deriving from the qualification attributed.

Brazil: Law n. 14,611/2023 on equal pay enacted

  • On 4 July 2023, Brazil enacted Law n. 14,611/2023 on equal pay for equal work between women and men.
  • It is part of a package of gender equality measures announced by the government in March 2023 to tackle discrimination and inequalities in the workplace.

  • On 10 August 2023, the Australian Human Rights Commission (‘AHRC’) published the Guidelines for Complying with the Positive Duty under the Sex Discrimination Act.
  • The objective is to support employers in fulfilling their positive duty to eliminate sex discrimination, sexual harassment, and conduct that creates a hostile work environment because of sex and related acts of victimisation in the workplace.
