European Council approves EU Directive to improve gender balance on company boards

  • On 17 October 2022, the European Council approved the EU Directive , which aims to promote a balanced gender representation on the boards of listed companies.
  • The Directive stipulates that members of the under-represented sex should hold at least 40% of non-executive board positions in listed companies by 2026.

Sweden: new labour reforms entered into force

  • The proposal to revise the Employment Protection Act (EPA), presented on June 2021, was finally adopted. 
  • The reform described as the “greatest reform of Swedish employment law in modern times” entered into force on 30 June 2022 and applied for the first time as of 1 October 2022.

Germany: a new law implements the Working Conditions Directive

  • On 23 June 2022, the German parliament passed a bill to implement the Working Conditions Directive (EU) 2019/1152 into German law. 
  • The German Bundestag passed the draft law (BT-Drs. 20/163620/2245) in the committee version (20/2392). If Bundesrat passes it without any objections, the new law will come into force as of 1 August 2022.

European Commission takes action on the transposition of the Whistleblower Protection Directive

  • Most of European Member States failed to transpose the EU Whistleblowing Directive within the established deadline of December 2021.
  • European Commission already sent a formal notice to 24 Members for the lack of transposition and to Sweden and Portugal for their delay in the application.

Belgium: Brussels Labour Tribunal qualifies riders as self-employed

  • On 8 December 2021, the Labour Tribunal of Brussels ruled that Deliveroo riders should not be qualified as employees, but rather as self-employed workers. 
  • It is the first ruling on the labour relationship qualification of workers in the platform economy by a labour tribunal or court in Belgium.
